Article 19B, Section 509-p of the New York State Vehicle and Traffic Law contains the definition of “commercial motor vehicle.” This term means any person, corporation, or organization that uses one or more commercial vehicles and uses the commercial vehicle in whole or in part within the State of New York in connection with the operation or management of any business.
Speeding Tickets In New York State
Section 509-p further states that “commercial motor vehicle” means a motor vehicle or combination motor vehicle with a gross vehicle weight of more than ten thousand pounds that is used commercially for the transportation of goods and must include a towing truck that with full vehicle weight. at least eight hundred and six pounds.
This is a broad definition that applies to freight vehicles; for example a furniture store that uses only one car for delivery.
Article 19B of the VTL imposes *several obligations on commercial vehicle carriers and drivers of such carriers, including VTL 509-r which requires written applications to be hired by a commercial vehicle carrier,
*VTL 509-s requires a commercial dealer to check the driving record of each of its drivers every 12 months,

*VTL 509-u which requires the commercial dealer to maintain a file on the qualifications of each driver and finally
*VTL 509-v which gives the Transport Commissioner the right to inspect these records, among other powers of the Transport Commissioner.
_ Penalties for violating Section 19B of the VTL or the rules and regulations of the Transportation Commissioner under Section 19B of the VTL include a fine of not less than $250 nor more than $1,000.
